What This Means (2024 FDD)
According to Care Plus Medical Ucc's 2024 Franchise Disclosure Document, the selection of a site is a mutual decision. The franchisee proposes the site, and Care Plus Medical Ucc must approve it. The FDD specifies that if Care Plus Medical Ucc and the franchisee cannot agree on a site, the franchisee will be unable to meet the obligation to develop and open the franchise by the deadline outlined in the franchise agreement.
Unless Care Plus Medical Ucc agrees to extend the deadline, the franchisee will be considered in default. This default gives Care Plus Medical Ucc the right to terminate the franchise agreement.
This aspect of the franchise agreement highlights the importance of site selection and the potential consequences of disagreement. Prospective franchisees should carefully consider potential locations and ensure they align with Care Plus Medical Ucc's approval criteria, which include general location, neighborhood, competition, trade area demographics, traffic patterns, parking, size, physical characteristics of existing buildings, and lease terms. Franchisees should also be aware of the 30-day time limit Care Plus Medical Ucc has to approve or disapprove a site after all required documents are submitted.
