What This Means (2024 FDD)
According to Care Plus Medical Ucc's 2024 Franchise Disclosure Document, the Effective Date is the date the Franchise Agreement is signed by Care Plus Medical UCC, LLC, and it marks the commencement of the agreement. The agreement between Care Plus Medical UCC and the franchisee is effective as of this date.
The Effective Date is significant because it determines the start of the 10-year term of the Franchise Agreement. The franchisee's rights and obligations under the agreement begin on this date. For example, the franchisee must pay an initial franchise fee upon signing the agreement, presumably around the Effective Date.
Furthermore, the Effective Date is relevant to the renewal or successor agreement process. The franchisee must notify Care Plus Medical UCC of their election to renew the agreement between 90 and 180 days prior to the end of the term, which is calculated from the Effective Date. If the franchisee continues to operate the business after the expiration of the term without a renewal agreement, Care Plus Medical UCC has specific rights, including the right to require the franchisee to cease operations.
