Under the direct ownership path for the ownership, development, and operation of a Franchised Business, you must be a Licensed Provider who is permitted to own and operate a business offering medical products and services under applicable state law, or you must own and operate the Franchised Business in a state that permits individuals who are not Licensed Providers to own and operate businesses offering medical products and services ("Direct Ownership Model"). You must sign our standard Franchise Agreement for the ownership, development, and operation of a Franchised Business under the Direct Ownership Model.

What This Means (2024 FDD)
According to Care Plus Medical Ucc's 2024 Franchise Disclosure Document, the Direct Ownership Model has geographic limitations based on state law. Specifically, to qualify for the Direct Ownership Model, a franchisee must either be a Licensed Provider permitted to own and operate a business offering medical products and services under applicable state law, or they must operate the Franchised Business in a state that permits individuals who are not Licensed Providers to own and operate such businesses. This means that the ability to use the Direct Ownership Model depends on whether the state allows non-licensed individuals to own and operate businesses offering medical products and services.
This has significant implications for prospective franchisees. If a potential franchisee is not a Licensed Provider, their ability to use the Direct Ownership Model is restricted to states that allow non-licensed individuals to own and operate medical businesses. This could limit the geographic locations where a franchisee can establish a Care Plus Medical Ucc franchise under the Direct Ownership Model. Franchisees need to investigate the specific laws in their desired location to ensure compliance.
Care Plus Medical Ucc emphasizes that franchisees are solely responsible for ensuring that the ownership, development, and operation of the Franchised Business complies with all applicable local, state, and federal laws and regulations. The FDD also advises consulting with a legal advisor regarding the laws and regulations and the permit, license, and certificate requirements that may apply to the business before signing a Franchise Agreement. This highlights the importance of due diligence in understanding the legal landscape of the chosen location to ensure compliance with all applicable laws and regulations.
