What This Means (2024 FDD)
According to Care Plus Medical Ucc's 2024 Franchise Disclosure Document, customer data is considered Confidential Information. Specifically, all customer data and other non-public data generated by the Business is Confidential Information and is exclusively owned by Care Plus Medical UCC. However, Care Plus Medical UCC licenses such data back to the franchisee without charge, but solely for the franchisee's use in connection with the Business during the term of the Franchise Agreement.
This means that while franchisees collect and utilize customer data in their daily operations, the ownership of that data resides with Care Plus Medical Ucc. Upon termination of the franchise agreement, the franchisee's right to use this data also ends. This is a fairly standard practice in franchising, as it allows the franchisor to maintain control over valuable customer information and ensure consistency across the brand.
For a prospective franchisee, this has several implications. First, they must adhere to Care Plus Medical Ucc's policies regarding data privacy and security. Second, they need to be aware that the customer data they build during the term of the agreement is not an asset they can take with them if they leave the system. Finally, they should ensure they understand the scope of the license granted to them by Care Plus Medical Ucc to use the data during the term of the agreement.
