What This Means (2024 FDD)
According to Care Plus Medical Ucc's 2024 Franchise Disclosure Document, the location for arbitration will be the city and state where Care Plus Medical UCC's headquarters are located. This means that if a dispute arises between the franchisee and Care Plus Medical Ucc that requires arbitration, the proceedings will occur at the company's main office location. Franchisees should consider the potential travel and logistical costs associated with this requirement, especially if they are located far from Care Plus Medical Ucc's headquarters.
This arrangement is fairly common in franchising, as it allows the franchisor to manage disputes in a location convenient for their personnel and legal resources. However, it can create a disadvantage for franchisees who may face higher costs to participate in the arbitration process. Franchisees should factor this into their assessment of the overall franchise opportunity and consider negotiating for a more neutral or convenient location if possible.
It is important to note that the Washington Addendum to the Franchise Agreement provides an exception for franchises purchased in Washington state. In such cases, the arbitration site must be either in the state of Washington, or in a place mutually agreed upon at the time of the arbitration, or as determined by the arbitrator. This addendum reflects Washington's franchise investment protection laws, which aim to provide additional safeguards for franchisees within the state.
