What This Means (2025 FDD)
According to Card My Yard's 2025 Franchise Disclosure Document, for franchises purchased in Washington, the arbitration or mediation site will be in the state of Washington. However, the location can be a place mutually agreed upon at the time of the arbitration or mediation, or as determined by the arbitrator or mediator at the time of arbitration or mediation.
This means that if a Card My Yard franchisee purchases a franchise in Washington state and a dispute arises that leads to arbitration or mediation, the proceedings will generally take place in Washington. This offers a degree of convenience and familiarity for the franchisee, as they won't have to travel to another state to resolve the issue.
However, there is flexibility in the location. The franchisee and Card My Yard can agree to a different location for the arbitration or mediation. Additionally, the arbitrator or mediator has the authority to determine the location of the proceedings. This flexibility could be beneficial if a neutral location is desired or if circumstances make Washington state an impractical location.
It is also important to note that the FDD states that if litigation is not precluded by the franchise agreement, a franchisee may bring an action or proceeding arising out.
