Can I relocate my Card My Yard business without your consent?

You have been granted the right to operate a Card My Yard business at the Franchise Location listed in Exhibit C to this Agreement.

You must not relocate the Card My Yard business without our express prior written consent, except that our consent will not be required if your Franchise Location is your home and you move to a new residence within your Protected Area.

If you are unable to continue the operation of the Card My Yard business at the Franchise Location because of the occurrence of an event of Force Majeure or for other reasons not constituting an event of default under this Agreement, you may request our consent to relocate the Card My Yard business to another location in the Protected Area.

Such request must be submitted to us as soon as possible (but in no event longer than 10 days) after the date you discover you will be unable to continue the operation of the Card My Yard business at the Franchise Location.

If we grant you the right to relocate the Card My Yard business, you must comply with such reasonable site selection and construction procedures as we may require.

What This Means (2025 FDD)

According to Card My Yard's 2025 Franchise Disclosure Document, franchisees generally need the franchisor's express prior written consent to relocate their Card My Yard business. However, there is an exception: if the Franchise Location is the franchisee's home, relocation to a new residence within the Protected Area does not require Card My Yard's consent.

If an event of Force Majeure or other reasons (not constituting a default) make it impossible to continue operating at the current Franchise Location, a franchisee can request consent to relocate within their Protected Area. This request must be submitted within 10 days of discovering the inability to continue operations at the current location. If Card My Yard grants the relocation request, the franchisee must adhere to their site selection and construction procedures.

Operating the Card My Yard business or selling products/services at any location other than the approved Franchise Location without prior written consent constitutes a breach of the agreement. Abandoning the business or losing the right to occupy the Franchise Location also constitutes a breach, unless it involves moving the home-based business within the Protected Territory or results from a Force Majeure event where relocation approval is sought within 30 days.
