You agree that any advertising, promotion and marketing you conduct, whether required by this Agreement or voluntarily undertaken by you, will be completely clear and factual and not misleading and will conform to the highest standards of ethical marketing and the promotion policies that we prescribe from time to time. If you do not receive written approval within fifteen (15) days after our receipt ofsuch materials, we will be deemed to have disapproved such materials. You may not use any advertising or promotional materials that we have disapproved. Our approval of any advertising material may be withdrawn in our sole discretion at any time.

What This Means (2025 FDD)

Based on the 2025 Franchise Disclosure Document, Card My Yard requires that any advertising, promotion, and marketing conducted by franchisees be completely clear, factual, and not misleading. It must also conform to the highest standards of ethical marketing and the promotion policies that Card My Yard prescribes.

Any advertising, promotional, and marketing materials that Card My Yard has not prepared or previously approved must be submitted to them for approval at least 20 days before use. If written approval is not received within 15 days after Card My Yard receives the materials, the materials will be considered disapproved. Franchisees may not use any advertising or promotional materials that Card My Yard has disapproved, and Card My Yard can withdraw approval of any advertising material at any time.

While the FDD does not specifically address the use of public figures with controversial backgrounds, the broad control Card My Yard exerts over advertising and promotional materials suggests that franchisees would need to seek approval for any campaign involving such figures. The requirement for ethical marketing and the ability of Card My Yard to withdraw approval at any time provide a mechanism for them to prevent the use of figures that could reflect negatively on the brand.
