D. Payment Processing and Software Programs. A centralized payment processing function on our website and processing of all customer payments, sales tax reporting and payment and remittance of Net Proceeds to you bi-weekly. For a reasonable fee, we may also provide Software Programs that we acquire or develop for use in the System; provided, that we are under no obligation to develop or acquire such Software Programs.

What This Means (2025 FDD)

According to Card My Yard's 2025 Franchise Disclosure Document, Card My Yard is not obligated to develop or acquire Software Programs for use in the System. While Card My Yard may provide Software Programs that they acquire or develop for use in the System for a reasonable fee, they are under no obligation to do so.

Card My Yard specifies that franchisees must use the Computer System, if any, that Card My Yard designates for operation of the Card My Yard business. Card My Yard may modify the specifications and components of any Computer System from time to time. As part of the Computer System, franchisees may be required to obtain specified computer hardware and/or software, including a license to use Software Programs developed by Card My Yard or others.

Changes to the Computer System specifications may require franchisees to incur costs to purchase, lease, and/or license new or modified computer hardware and/or software and to obtain service and support for the Computer System during the term of the Franchise Agreement. Card My Yard cannot estimate the future costs of the Computer System (or additions or modifications), and the cost to the franchisee of obtaining the Computer System (including software licenses) or additions or modification may not be fully amortizable over the remaining term of the Agreement. However, the franchisee agrees to incur such costs within sixty (60) days after receiving notice from Card My Yard. Card My Yard has the right to charge a reasonable systems fee for any software or systems modifications and enhancements specifically made for them that are licensed to the franchisee and other maintenance and support services that Card My Yard or its affiliate may furnish.
