What This Means (2025 FDD)
According to Card My Yard's 2025 Franchise Disclosure Document, the Marketing Fund has not yet been established. As such, no contributions have been made to, or spent by, the Fund in the last fiscal year. However, Card My Yard reserves the right to establish a franchisee marketing fund in the future.
If the Marketing Fund is established, franchisees may be required to contribute up to 2% of their Card My Yard business's Gross Sales. The initial periodic contributions will be the greater of (a) one-half of one percent (0.5%) of the Card My Yard business' monthly Gross Sales or (b) $25 per month in the first 12 months of the agreement; $40 per month in months 13 through 24; and $65 per month in each 12-month period thereafter. Card My Yard has the discretion to increase the contribution amount with 30 days' written notice, but it will not exceed 2% of Gross Sales, with a minimum of $20 per month. These contributions would be in addition to local advertising expenses.
Card My Yard, or a designated party, will administer the Fund separately, but it will not be a trust or escrow account, and Card My Yard will not have fiduciary obligations. The funds may be used for various advertising, promotion, and marketing activities, including producing advertising materials, administering advertising programs, maintaining a website, and supporting customer loyalty programs. The funds will not be used to solicit the sale of franchises, except for website development and maintenance. An annual statement of the Fund's operations will be prepared and made available upon request. Any unspent amounts will be applied to advertising activities or administrative expenses in the following fiscal year. Card My Yard may terminate the Fund at any time with 30 days' written notice, and any unspent monies will be distributed to the contributors in proportion to their contributions during the preceding 12-month period.
