"Marketing Fund" or "Fund" means the marketing fund described in Section IX.C. of this Agreement.

"Marks" means the trade names, trademarks, service marks, logos, emblems and other indicia of origin that we have designated, and may hereafter designate, in writing for use in connection with theSystem, including, but not limited to, the mark "Card My Yard."

"Net Proceeds" as used herein, has the meaning assigned in Section V.D of this Agreement.

"Opening Date" means the date the Card My Yard business first opens for business to the public.

What This Means (2025 FDD)

According to Card My Yard's 2025 Franchise Disclosure Document, the mark used to identify the Card My Yard system includes the mark "Card My Yard." The FDD also states that the 'System' is identified by certain Marks. The 'System' includes certain confidential information which provides economic advantages to Card My Yard and licensed users of the System.

Card My Yard grants franchisees the right to use their marks during the term of the agreement, in accordance with the agreement's standards and specifications. Franchisees acknowledge that Card My Yard owns all rights to the marks and the goodwill associated with them. Any goodwill arising from the franchisee's use of the marks will benefit Card My Yard, and franchisees cannot contest the validity of the marks.

Franchisees must operate and advertise their Card My Yard business under the name "Card My Yard," without any prefix or suffix, unless otherwise authorized. They must also identify themselves as the owner of the Card My Yard business in conjunction with any use of the marks, including on invoices, order forms, receipts, and contracts. Card My Yard retains the right to substitute different marks if the current marks can no longer be used or if the substitution benefits the System. If this occurs, the franchisee agrees to discontinue or modify their use of any of the marks at their own expense.
