What This Means (2025 FDD)
According to Card My Yard's 2025 Franchise Disclosure Document, unless otherwise indicated, all fees and expenses described in Item 6 are imposed uniformly by, and are payable to, Card My Yard. This applies to various fees such as liquidated damages for termination or non-reporting, audit fees, insurance reimbursement, enforcement costs, marketing fund contributions, interest and late fees, additional training fees, and on-site remedial training fees.
However, there are exceptions. Local marketing and cooperative advertising fees are typically paid directly to local marketing service providers. If a franchisee fails to meet the minimum spending requirements for local marketing, Card My Yard may require the franchisee to pay the corresponding amounts to them so that Card My Yard can purchase local marketing services for the franchisee's protected area.
Prospective franchisees should note that while most fees are paid directly to Card My Yard, it is essential to understand the specific conditions under which fees are payable to third-party local marketing service providers. Franchisees should also be aware that Card My Yard retains the right to increase certain fees based on market conditions, the cost of providing services, and future policy changes.
