When is the earliest that Card My Yard can require capital improvements to a franchise location?

Promptly upon our request, you must make improvements, renovations, updates and upgrades to the Card My Yard business to conform it to our then-current standards and specifications. Without limiting the foregoing, you agree that, if we request, you will make any capital improvements required by this Section VIII.D. on or after the second (2nd) anniversary of the Opening Date, or at such other time during the term of this Agreement that a majority of the Card My Yard businesses then operated by us or our Affiliates have made or are utilizing best efforts to make such improvements.

What This Means (2025 FDD)

However, the timing of these capital improvements is also tied to what a majority of other Card My Yard franchisees are doing. If a majority of franchisees operated by Card My Yard or its affiliates have already made or are actively working on similar improvements, Card My Yard can require the franchisee to make these changes at that time as well. This ensures that all locations are generally keeping pace with any system-wide upgrades or changes.
