When is the 'Designated Search Area' agreed upon for a Card My Yard franchise?

If applicable, the Designated Search Area will be agreed upon by you and us before your execution of the Franchise Agreement. If you choose to operate your Card My Yard business from your home then there will be no need to identify a Designated Search Area. You will have no exclusivity or other rights within the Designated Search Area other than the right to identify a proposed site for your Card My Yard business. After you locate a site acceptable to us or notify us that you will operate your Card My Yard business from your home we will grant you a "Protected Area" around your site as described below.

What This Means (2025 FDD)
According to Card My Yard's 2025 Franchise Disclosure Document, the Designated Search Area is agreed upon before the execution of the Franchise Agreement. This area is relevant if the franchisee chooses to operate the Card My Yard business from a site other than their home. The agreement on the Designated Search Area is documented in Exhibit C of the Franchise Agreement. If the franchisee operates from home, there is no need to identify a Designated Search Area.
This agreement is important because it defines the non-exclusive area within which a franchisee can propose a site for their Card My Yard business, if they choose not to operate from home. However, it's important to note that the franchisee has no exclusivity within this Designated Search Area other than the right to identify a proposed site. The final site must be acceptable to Card My Yard.
Once a site is approved or the franchisee decides to operate from home, Card My Yard will grant a Protected Area around the site. The Protected Area, unlike the Designated Search Area, provides certain territorial protections, as detailed elsewhere in the FDD. Therefore, understanding the distinction between these two areas is crucial for prospective franchisees, especially those considering operating from a commercial location rather than their residence.
