"Computer System" means the computer hardware and software (including, without limitation, back office
software and point-of-sale software meeting ourspecifications and point-of-sale terminals that we may designate from time to time for use in the operation of Card My Yard businesses.

What This Means (2025 FDD)
According to Card My Yard's 2025 Franchise Disclosure Document, the definition of 'Computer System' explicitly includes back office software. The Computer System includes both hardware and software that meets Card My Yard's specifications, as well as point-of-sale terminals designated for use in the operation of Card My Yard businesses.
As a franchisee, you are required to use the Computer System that Card My Yard specifies and acknowledge that these specifications and components may change over time. These changes may require you to incur costs to purchase, lease, or license new or modified computer hardware and software, and to obtain service and support for the system during the term of the agreement. You are obligated to obtain the required components of the Computer System within 60 days of receiving notice from Card My Yard, even though the future costs cannot be estimated and may not be fully amortizable over the agreement's term.
Card My Yard also has the right to charge a reasonable systems fee for software or system modifications and enhancements made specifically for them, which are then licensed to you, as well as for maintenance and support services provided by Card My Yard or its affiliates. This ensures that franchisees remain compliant with the technological standards set by Card My Yard, although it may involve unforeseen expenses.
