- b. Franchisee shall open the Restaurant to the general public within one (1) year from the date of this Agreement. However, Franchisee may not commence operation of the Restaurant until Franchisee has satisfied all conditions set forth in this Agreement required to be satisfied by Franchisee prior to opening. If Franchisee fails to timely open the Restaurant, Franchisor may terminate this Agreement and retain all amounts Franchisee has paid to Franchisor or its affiliates.

What This Means (2025 FDD)
According to Carbones Pizzeria's 2025 Franchise Disclosure Document, a franchisee may not commence restaurant operations until they have met all the conditions outlined in the franchise agreement that must be satisfied before opening. The franchisee is required to open the restaurant to the public within one year from the date of the agreement. Failure to open the restaurant on time may result in Carbones Pizzeria terminating the agreement and retaining all payments made by the franchisee.
Prior to opening, Carbones Pizzeria will provide the franchisee with a prototypical design package and either approve the franchisee's design package or disapprove it if it differs from the one provided. Carbones Pizzeria will also provide the franchisee with the Manual. The franchisee must operate the restaurant according to the Carbone System, maintain adequate product supplies, and employ sufficient staff to ensure maximum capacity and efficiency.
Each owner and all operations managers, or anyone with management responsibility, must successfully complete Carbones Pizzeria's initial training program before opening to the public. This training is provided at no additional cost, but the franchisee is responsible for covering all costs and expenses for their owners and employees to attend. The franchisee must also secure an approved location within 120 days of signing the agreement.
