What This Means (2025 FDD)
According to the 2025 Carbones Pizzeria Franchise Disclosure Document, a franchisee is generally restricted from delivering into another Carbone's Pizza franchisee's territory. However, a Carbones Pizzeria franchisee can deliver outside of their designated territory under a specific condition.
Specifically, the franchisee is permitted to deliver outside their territory into areas that are not within another Carbone's Pizza franchisee's territory. This allows a franchisee to potentially expand their delivery range to capture customers in underserved areas, provided those areas are not already assigned to another franchisee.
However, this right is not absolute. If Carbones Pizzeria grants a new franchise territory that includes an area where an existing franchisee is already delivering, the existing franchisee must immediately cease delivery activities in that area. This clause protects the exclusivity of newly granted franchise territories and prevents conflicts between franchisees. This means that while a Carbones Pizzeria franchisee can initially deliver outside their territory into unfranchised areas, this is subject to change if the franchisor expands and awards that area to a new franchisee.
