Except as discussed above, we do not restrict the customers you may serve, and you generally may solicit customers outside your territory, including through channels of distribution such as the Internet, telemarketing or other direct marketing sales. However, you may not offer or sell products and services via the Internet (whether inside or outside your Franchisee Territory). In addition, all of your advertising must be approved by us in writing before you publish or distribute such marketing materials, whether it is traditional advertising or advertising over the Internet, including any social media advertising. We and our affiliates have the right to sell products and services to your customers and to others in and outside your Franchise Territory, using the Carbone's Pizza or Carbone's Pizzeria name, or using any other name, through any channel of distribution, including the Internet, catalog sales, telemarketing, or other direct marketing, and may do so in your Franchisee Territory without any compensation to you.

What This Means (2025 FDD)
According to Carbones Pizzeria's 2025 Franchise Disclosure Document, franchisees generally are not restricted in who they may serve and can solicit customers outside their territory using methods like the Internet, telemarketing, or direct marketing. However, franchisees are prohibited from offering or selling products and services via the Internet, whether inside or outside their Franchisee Territory. All advertising materials, whether traditional or online, including social media, must receive prior written approval from Carbones Pizzeria.
Carbones Pizzeria and its affiliates retain the right to sell products and services to any customers, both within and outside the franchisee's territory, using the Carbones Pizza or Carbone's Pizzeria name, or any other name, through any distribution channel, including the Internet, catalog sales, telemarketing, or other direct marketing, without compensating the franchisee. This means that while franchisees can generally pursue customers, Carbones Pizzeria can also directly compete for those same customers.
Furthermore, if a Carbones Pizzeria franchisee offers pizza delivery services, they may deliver both within and outside their designated territory, provided they do not deliver into another franchisee's exclusive territory. However, this delivery arrangement is non-exclusive, and if Carbones Pizzeria grants a new franchise that includes an area where the existing franchisee was delivering, the existing franchisee must cease deliveries to that area. This highlights the importance of understanding the territory boundaries and potential for future franchise locations to impact delivery service areas.
