Is pizza delivery outside of a Carbones Pizzeria franchisee's territory exclusive?

Carbones_Pizzeria Franchise · 2025 FDD

Answer from 2025 FDD Document

If you offer pizza delivery services, you may deliver in your franchise territory and outside of it so long as you are not delivering into the franchisee territory of any other Carbone's Pizza franchisee. These deliveries are on a non-exclusive basis. If we grant a franchise that includes an area that you were delivering into, you can no longer deliver into that area.

What This Means (2025 FDD)

According to Carbones Pizzeria's 2025 Franchise Disclosure Document, pizza delivery outside of a franchisee's territory is not exclusive. Franchisees may deliver outside their territory as long as they do not deliver into another Carbone's Pizza franchisee's territory. However, this right is not exclusive, and if Carbones Pizzeria grants a franchise that includes an area a franchisee was previously delivering to, the franchisee can no longer deliver into that area.

This non-exclusive delivery arrangement means that a Carbones Pizzeria franchisee could face competition from other franchisees or from the franchisor itself in areas outside their primary territory. This could impact potential sales and revenue, especially in areas near the edge of the franchisee's territory. It is important to note that Carbones Pizzeria does not restrict the customers a franchisee may serve and franchisees generally may solicit customers outside their territory through various channels, excluding the Internet.

This type of arrangement is fairly common in the franchise industry, where franchisors often balance the need to provide franchisees with sufficient territory to operate profitably with the desire to maximize brand presence and market penetration. Prospective Carbones Pizzeria franchisees should carefully consider the potential for competition from other franchisees and the franchisor when evaluating the opportunity and projecting potential earnings. Understanding the dynamics of delivery areas and customer solicitation policies is crucial for success.
