The procedure developed by the mediator shall control the mediation proceeding.
It is acknowledged that the parties intend to expedite the resolution of any such dispute through the mediation process.
Each party shall pay one-half of the costs of the mediation and their own attorney fees and costs.

What This Means (2025 FDD)
According to the 2025 Carbones Pizzeria Franchise Disclosure Document, the procedure developed by the mediator will control the mediation proceeding.
In the event of a dispute, either the franchisee or Carbones Pizzeria can request a meeting to resolve the issue. If the dispute remains unresolved after the meeting, the parties will then submit to mediation in Hennepin County, Minnesota, using a mutually agreed-upon mediator. The party initiating the resolution process provides a list of three qualified mediators, from which the other party selects one to mediate the dispute.
Both Carbones Pizzeria and the franchisee are expected to cooperate to expedite the resolution of any dispute through mediation. Each party is responsible for paying one-half of the mediation costs, as well as their own attorney fees and costs. If mediation is unsuccessful, the dispute will proceed to arbitration in Hennepin County, Minnesota.
