Promptly after preparing the plans for your Hotel's construction or remodeling, you must prepare and deliver to us for our approval a plan for conducting and administering the F&B Operations at the Hotel (the "F&B Operations Plan"). The F&B Operations Plan will contain the identity of any proposed restaurant operator or other operator of some or all F&B Operations at the Hotel (other than you or your approved management company) (each an "F&B Operator") and the restaurant concept(s) that you plan to incorporate as part of or adjacent to the Hotel. You must make the modifications to the F&B Operations Plan that we reasonably specify and ensure that the Hotel and its F&B Operations operate according to the approved F&B Operations Plan. You may not make any material changes to the F&B Operations Plan (including any changes to the proposed restaurant concept(s) and/or F&B Operator(s)) without our prior written approval. Before the Hotel begins operating under the Proprietary Marks, you must require each F&B Operator to sign the documents we reasonably specify to protect our (and our affiliates') intellectual property and other rights. According to the 2025 Caption By Hyatt Franchise Disclosure Document, the F&B Operations Plan that a franchisee must prepare and deliver for approval needs to include specific details regarding the food and beverage operations at the hotel. This plan must identify any proposed restaurant operator or any other operator managing any part of the food and beverage operations at the hotel, excluding the franchisee or their approved management company. These operators are referred to as "F&B Operators." The plan must also outline the restaurant concepts that the franchisee intends to incorporate either as part of or adjacent to the Caption By Hyatt hotel.
Caption By Hyatt requires that franchisees make any modifications to the F&B Operations Plan that they reasonably specify and ensure that the hotel and its food and beverage operations are run according to the approved plan. Franchisees cannot make any significant changes to the F&B Operations Plan, including changes to the proposed restaurant concepts or F&B Operators, without obtaining prior written approval from Caption By Hyatt.
Before the Caption By Hyatt hotel begins operating under the brand's trademarks, the franchisee must ensure that each F&B Operator signs documents that Caption By Hyatt reasonably specifies. These documents are designed to protect the intellectual property and other rights of Caption By Hyatt and its affiliates. Additionally, Caption By Hyatt has the option to request that franchisees submit any proposed lease or other agreement between the franchisee (or their affiliate or management company) and the F&B Operator for prior approval. In such cases, the franchisee cannot sign any lease or agreement that Caption By Hyatt has not approved.
