During your evaluation process, and before receiving any Confidential Information, you must sign the Confidentiality Agreement (Exhibit F) (the "Confidentiality Agreement"). Because we may engage in negotiations with you and other franchisees, you may sign a Franchise Agreement with us that differs significantly from the agreements that other franchisees sign for Brand Hotels.

What This Means (2025 FDD)
According to the 2025 Caption By Hyatt Franchise Disclosure Document, before a prospective franchisee can receive any Confidential Information regarding the franchise, they must sign a Confidentiality Agreement. This agreement is listed as Exhibit F in the FDD.
This requirement is a standard practice in franchising. It protects Caption By Hyatt's sensitive business data, trade secrets, and operational methods. The Confidentiality Agreement ensures that potential franchisees do not disclose or misuse the information they receive during the evaluation process.
For a prospective Caption By Hyatt franchisee, this means that they will need to carefully review and understand the terms of the Confidentiality Agreement before signing it. This agreement likely restricts the franchisee from sharing information about Caption By Hyatt's operations, financial performance, and other proprietary details with third parties. It is advisable to seek legal counsel to fully understand the implications of the agreement before proceeding with the franchise application process.
