Under what condition must a Canopy Lawn Care franchisee designate a Designated Business Manager?

You must directly supervise the Lawn Care Business at your franchised location. The direct, onsite supervision must be done by a Designated Business Manager, which could be one of your employees. The Designated Business Manager is not required to own a beneficial interest in the business entity.
If we believe you lack sufficient business experience, you must designate a Designated Business Manager to act as the operating manager for your Lawn Care Business. We must approve the selection of the Designated Business Manager before signing the Franchise Agreement. The Designated Business Manager must attend and successfully complete the initial training program, and must abide by the obligations in the Franchise Agreement and the Operating Manual. The Designated Business Manager must agree to the same confidentiality and non-competition obligations that you are required to abide by (see Attachment A to the Franchise Agreement).

According to the 2025 Canopy Lawn Care FDD, a franchisee must designate a Designated Business Manager to act as the operating manager for their Lawn Care Business if Canopy Lawn Care believes the franchisee lacks sufficient business experience. The selection of the Designated Business Manager is subject to Canopy Lawn Care's approval before the Franchise Agreement is signed.
The Designated Business Manager is required to attend and successfully complete the initial training program and must adhere to the obligations outlined in both the Franchise Agreement and the Operating Manual. Furthermore, the Designated Business Manager must agree to the same confidentiality and non-competition obligations that the franchisee is required to abide by, as detailed in Attachment A of the Franchise Agreement.
This requirement ensures that even franchisees without prior business experience have qualified management in place to operate the Canopy Lawn Care business effectively. It also protects Canopy Lawn Care's interests by ensuring that the Designated Business Manager is bound by the same confidentiality and non-competition terms as the franchisee.
