What This Means (2025 FDD)
According to the 2025 Franchise Disclosure Document, Enterprise Fleet Management, Inc. has a few roles in the Canopy Lawn Care vehicle lease agreement. First, a separate maintenance agreement may exist between Enterprise Fleet Management, Inc. and the franchisee (Lessee) if the schedule includes a charge for maintenance. The agreement stipulates that the Lessor (the party leasing the vehicle to the franchisee) bears no responsibility if Enterprise Fleet Management fails to perform its obligations under the maintenance agreement or fails to reimburse the franchisee for maintenance or repair costs.
Second, the document states that neither a casualty affecting a vehicle nor any defect or lack of governmental approval, nor any breach by Enterprise Fleet Management, Inc. of any maintenance agreement will relieve the franchisee (Lessee) from their obligations under the lease agreement. This includes the obligation to make rental and other payments.
Finally, Enterprise Fleet Management, Inc. or an affiliate may administer the Master Equity Lease Agreement on behalf of the Lessor and perform service functions typically performed by the Lessor. This means Enterprise Fleet Management can act as a servicer, agent, successor, or assign on behalf of the Lessor.
