For a Canopy Lawn Care franchise, where can I find the confidentiality and non-competition obligations that the Designated Business Manager must agree to?
Canopy_Lawn_Care Franchise · 2025 FDDAnswer from 2025 FDD Document
The Designated Business Manager must attend and successfully complete the initial training program, and must abide by the obligations in the Franchise Agreement and the Operating Manual. The Designated Business Manager must agree to the same confidentiality and non-competition obligations that you are required to abide by (see Attachment A to the Franchise Agreement).

What This Means (2025 FDD)
According to Canopy Lawn Care's 2025 Franchise Disclosure Document, the confidentiality and non-competition obligations that the Designated Business Manager must agree to are found in Attachment A to the Franchise Agreement. Item 15 states that the Designated Business Manager must agree to the same confidentiality and non-competition obligations that the franchisee is required to abide by.
This means that if a franchisee is not directly supervising the Lawn Care Business themselves and instead designates a Designated Business Manager, that manager is bound by the same restrictions regarding confidential information and competition as the franchisee. This is a common practice in franchising to ensure that key personnel are legally obligated to protect the franchisor's interests.
Prospective franchisees should carefully review Attachment A to fully understand the scope and duration of these obligations for both themselves and their Designated Business Manager. Understanding these obligations is crucial, as failure to comply could result in legal action from Canopy Lawn Care.
