4.8.7 Franchisee will: (i) learn and comply with all applicable Privacy Laws; (ii) learn and comply with Brand Standards related to Privacy Laws and the privacy and security of Customer Information; (iii) learn and comply with any posted privacy policy and representations made to individuals identified by Customer Information, and communicate any limitations required to authorized receiving parties in compliance with Privacy Laws; (iv) refrain from any action or inaction that could cause Franchisor or its Affiliates to breach Privacy Laws; (v) maintain reasonable physical, technical, and administrative safeguards and related policies for Customer Information to protect it from unauthorized processing, destruction, modification, or use that would violate this Agreement, the Manual, or any Privacy Law; (vi) Execute necessary acts, documents, and things to keep Franchisor and its Affiliates in compliance with Privacy Laws; (vii) Immediately report to Franchisor any breach of requirements regarding Customer Information or Privacy Laws, or any theft or loss (or apparent or alleged theft or loss) of Customer Information (excluding Customer Information of Franchisee's own officers, directors, shareholders, employees, or service providers).

4.8.8 Franchisee will provide Franchisor with information, reports, and audit results regarding data security policies, procedures, or technical controls related to Customer Information upon request. Franchisee will also provide access to Franchisee's computer system, records, processes, and practices involving Customer Information processing to mitigate security incidents or conduct audits. Franchisee will indemnify, defend, and hold Franchisor and its Affiliates harmless in connection with any claim or action arising from theft, loss, or misuse of Customer Information, or breach of terms related to data security, Privacy Laws, or Customer Information. Franchisee will notify Franchisor immediately upon discovering any theft, loss, or misuse of Customer Information and will undertake remediation efforts, cooperate with Franchisor's remediation efforts, and prevent recurrence of incidents at Franchisee's expense. Franchisee will not make public comments regarding data security incidents without Franchisor's approval. Notifications to media or customers regarding theft or loss of Customer Information will be handled exclusively by Franchisor. If legally obligated to notify customers, Franchisee must notify Franchisor in writing and limit notices to those required by law or pre-approved by Franchisor. Franchisee will cooperate with Franchisor in sending such notices.
