What This Means (2025 FDD)
According to the 2025 Camp Margaritaville FDD, Camp Margaritaville retains sole and exclusive ownership of all right, title, and interest in and to all Customer Data. However, Camp Margaritaville grants the CRM Provider and Connection Platform a non-exclusive, fully paid, worldwide, and irrevocable license to use the Customer Data as required to ensure the provision of CRM Services. This license includes the right to copy, anonymize, aggregate, process, disaggregate, and display Disaggregated Data for the purposes of compiling it with similar data from other clients for internal statistical or performance analysis.
This means that while the franchisee does not own the customer data, Camp Margaritaville does. Camp Margaritaville also grants certain rights to third-party CRM providers to utilize the data for specific purposes. The franchisee must understand that they do not have ownership rights to the customer data they collect and must operate under the understanding that Camp Margaritaville can utilize this data as it sees fit, within the bounds of the agreement.
This arrangement is fairly common in franchising, where the franchisor seeks to maintain control over customer data to ensure brand consistency and to leverage data for marketing and analytical purposes across the entire franchise system. The franchisee should be aware of the data privacy and security implications and ensure they comply with all applicable laws and regulations regarding the collection, storage, and use of customer data.
