What This Means (2025 FDD)
According to the 2025 Camp Margaritaville FDD, individual purchasers of dwellings are restricted in their use of Camp Margaritaville's intellectual property when reselling their properties. Specifically, individual purchasers do not have the right to use any part of the Camp Margaritaville Intellectual Property to market, advertise, promote, or sell any Dwelling, except to indicate the location within the Project or that it is a Dwelling.
Camp Margaritaville requires the franchisee to adopt and enforce covenants and deed restrictions to ensure these restrictions are enforced. This means that when a franchisee sells a dwelling, the subsequent purchaser is bound by these same limitations regarding the use of the Camp Margaritaville Intellectual Property.
These restrictions are in place to protect the Camp Margaritaville brand and ensure consistent marketing and advertising practices. By limiting how individual purchasers can use the brand's intellectual property, Camp Margaritaville maintains control over its image and messaging. This is a common practice in franchising, where brand consistency is crucial for maintaining customer loyalty and overall brand value.
For a prospective Camp Margaritaville franchisee, this means they are responsible for enforcing these restrictions on dwelling owners. This includes implementing and overseeing the necessary legal mechanisms, such as covenants and deed restrictions, to prevent unauthorized use of the Camp Margaritaville Intellectual Property by individual dwelling owners during resale. Franchisees need to ensure that all sales and marketing plans comply with the franchisor's approved guidelines.
