What This Means (2025 FDD)
According to the 2025 Camp Margaritaville FDD, the franchisee is responsible for the sales and marketing of the Dwellings at Camp Margaritaville. However, all sales and marketing plans are considered a "Licensed Use" and are subject to the franchisor's approval. This means that while the franchisee has the task of promoting and selling the dwellings, Camp Margaritaville retains control over the branding and messaging used in these efforts.
This requirement for approval extends to any use of Camp Margaritaville's intellectual property in advertising, marketing, promotional, and public relations plans. The franchisee must obtain prior written approval from Camp Margaritaville for all materials referencing the brand's intellectual property. This includes digital, electronic, and computerized forms, such as those used on a Travel Services Website. If the franchisee does not receive written approval within 15 business days after Camp Margaritaville receives the materials, the materials are considered rejected.
The FDD emphasizes that Camp Margaritaville's customers' loyalty is a valuable asset, and meeting customer expectations for a quality experience is crucial. Therefore, Camp Margaritaville retains the right to approve or disapprove any use of its intellectual property to maintain brand standards. This ensures that all marketing efforts align with the brand's image and quality standards, which is a common practice in franchising to protect brand reputation and consistency across all locations.
