What This Means (2025 FDD)
According to Camp Margaritaville's 2025 Franchise Disclosure Document, franchisees must promptly inform Margaritaville of any suspicious or malicious activity, potential vulnerabilities, or security weaknesses they become aware of. This notification must be made in accordance with the terms outlined in the Branding Agreement.
This requirement ensures that Margaritaville is kept informed of any potential threats to the Camp Margaritaville system's security. By promptly reporting these issues, franchisees enable Margaritaville to take appropriate action to mitigate risks and protect sensitive data. This is particularly important in today's environment where data breaches and cyberattacks are increasingly common.
The FDD also states that franchisees must cooperate with Margaritaville in investigating any security breach and must use their best efforts to remedy any security breach attributable to them as soon as commercially possible. This includes preventing any further security breaches at the franchisee's expense, in accordance with applicable privacy rights, laws, regulations, and standards. This cooperation is essential for maintaining the integrity and security of the entire Camp Margaritaville brand and protecting customer information.
In addition to notifying Margaritaville of security issues, franchisees are also responsible for the actions and omissions of their employees, contractors, or other representatives concerning the treatment of Guest Information and Reservation Data. This underscores the importance of training and oversight to ensure that all parties handling sensitive information adhere to the required security protocols and privacy practices.
