For any data subject request submitted to Franchisee that requires Franchisor's cooperation or assistance for Franchisee to process the request in accordance with
Applicable Law (e.g., data subject requests that implicate Guest Profile Data), Franchisee shall:
(i) Upon receiving notice of the request, inform Franchisor of the request within 2 days by emailing Franchisor at legal@margaritaville.com.
(ii) Provide all relevant information and reasonable assistance requested by Franchisor in connection with the request.
(iii) Be responsible for processing and responding to the request in accordance with Applicable Law.
(iv) In its response back to the consumer, inform the consumer: (i) that Franchisee is part of a franchisor/franchisee relationship with Margaritaville Enterprises LLC, through which Franchisee owns and operates an individual Camp Margaritaville resort, or other branded resort or restaurant (as applicable); (ii) the data subject request that was submitted to Franchisee only applies to personal information collected and processed by Franchisee, and not personal information collected or processed by Margaritaville Enterprises LLC or any other Margaritaville branded hotel, resort, or restaurant; and (3) for any questions, comments, or data subject requests pertaining to Margaritaville Enterprises LLC or any other Margaritaville franchisee or licensee, the consumer should reach out to Margaritaville Enterprises LLC, the franchisee, or the licensee directly.

The 2025 Camp Margaritaville FDD outlines the procedures a franchisee must follow when dealing with data subject requests. If a franchisee receives a data subject request that requires Camp Margaritaville's cooperation or assistance, the franchisee must inform Camp Margaritaville of the request within two days. This notification must be done via email to legal@margaritaville.com.
In addition to the initial notification, the franchisee is obligated to provide all relevant information and reasonable assistance that Camp Margaritaville requests in connection with the data subject request. However, the franchisee retains the responsibility for processing and responding to the request in accordance with applicable law.
Furthermore, when responding to the consumer, the franchisee must disclose their relationship with Margaritaville Enterprises LLC, clarifying that they operate an individual Camp Margaritaville resort through a franchisor/franchisee relationship. The franchisee must also inform the consumer that the data subject request only applies to personal information collected and processed by the franchisee, and not information held by Margaritaville Enterprises LLC or other Margaritaville branded entities. Finally, the franchisee must instruct the consumer to contact Margaritaville Enterprises LLC or the relevant franchisee/licensee directly for any inquiries related to those entities.
