What This Means (2025 FDD)
According to Camp Margaritaville's 2025 Franchise Disclosure Document, when a franchisee receives or accesses Privacy Information, they must adhere to specific guidelines regarding its use and disclosure. The franchisee is obligated to collect, receive, transmit, store, dispose of, use, and disclose Privacy Information in accordance with the terms outlined in the Branding Agreement, as well as all relevant privacy and data protection laws and regulations. This means that the franchisee's handling of sensitive information is governed both by the contractual agreement with Camp Margaritaville and by applicable legal standards.
Furthermore, the franchisee must maintain Privacy Information in strict confidence, employing a level of care that is appropriate to prevent unauthorized access, use, or disclosure. This underscores the importance of implementing robust security measures to safeguard sensitive data from potential breaches or misuse. The franchisee's responsibility extends to ensuring that all employees, contractors, or other representatives engaged by the franchisee also adhere to these standards when handling Privacy Information.
Camp Margaritaville specifies that franchisees can use and disclose Privacy Information solely and exclusively for the purposes for which the information, or access to it, is provided. This limitation ensures that sensitive data is not used for any unauthorized or unintended purposes. The franchisee is also required to promptly notify Camp Margaritaville of any act or omission that compromises the security, confidentiality, or integrity of Privacy Information, or any breach or alleged breach of privacy practices, in accordance with the terms of the Branding Agreement. This reporting requirement enables Camp Margaritaville to take timely action to mitigate any potential damage resulting from a data breach or privacy violation.
