Customer represents, covenants, and warrants that Customer will use the Services only in compliance with the Services Provider's standard published policies and procedures then in effect, which may be amended from time to time and all applicable laws and regulations, and shall further complete all prerequisites and responsibilities as commercially reasonably requested by Margaritaville in connection with delivery of the Services.

According to Camp Margaritaville's 2025 Franchise Disclosure Document, both the customer (franchisee) and Margaritaville have prerequisites and responsibilities that must be completed for the delivery of services. The franchisee must complete tasks and provide deliverables within the time frames requested by Margaritaville. Additionally, the franchisee must provide Margaritaville with updates to any information immediately as changes occur to ensure the proper delivery of services.

Camp Margaritaville franchisees are responsible for the successful execution and delivery of the Brand Affinity and Perks Program at their resort. This includes participating in and honoring the terms of the program, offering the minimum perks specified in the manual, and providing the guest-selected perk to each member upon their visit. If a franchisee cannot honor a member's perk request, they must try to provide a perk of similar or greater value. Margaritaville may reimburse and compensate members if a resort fails to honor the terms of the Brand Affinity and Perks Program, and the franchisee will be responsible for reimbursing Margaritaville for the actual costs plus a 10% fee.

Camp Margaritaville franchisees must ensure all guest-facing team members review the training section of the Margaritaville Perks Program Manual and certify they understand the program's requirements. Front desk team members should be trained to enroll new guests in the Brand Affinity and Perks Program and track arriving perks members and their chosen perks. Franchisees must also comply with data protection laws, inform Margaritaville if they can no longer meet their obligations under these laws, and take actions and execute documents necessary for compliance with data protection laws by Margaritaville or its affiliates.

Camp Margaritaville franchisees must also inform Margaritaville of any data subject requests that require Margaritaville's cooperation within two days of receiving the request. They must provide all relevant information and assistance requested by Margaritaville and process and respond to the request in accordance with applicable law. Additionally, franchisees must inform consumers that they are part of a franchisor/franchisee relationship with Margaritaville Enterprises LLC and that the data subject request only applies to personal information collected and processed by the franchisee.
