Specifically, franchisees must participate in the established program for the sale and processing of gift cards at participating locations. This means that as a franchisee, you are required to implement and adhere to the Gift Card Program's rules and policies as set by Camp Margaritaville.

As part of this program, the franchisee will incur onboarding and implementation costs ranging from $5,000 to $15,000, depending on the existing POS and PMS systems and available amenities at the resort. Additionally, franchisees will need to enter into a Gift Card Participation Agreement with Givex, the third-party provider managing transaction processing and settlement services. This agreement is attached to the Technology Agreement as Exhibit E to the Franchise Agreement.

When a gift card is redeemed at a Camp Margaritaville Resort, the franchisee will be charged a percentage of the amount tendered. The charge is 2% if the gift card was purchased at the franchisee's resort or another Margaritaville-branded physical location. However, the charge increases to 5% if the gift card was purchased from the Margaritaville website or a non-branded third-party location. These fees are remitted to Camp Margaritaville or its affiliates to offset the costs of the Gift Card Program. Camp Margaritaville retains the right to modify the costs, redemption reimbursement amounts, and calculation factors of the Gift Card Program at any time. Franchisees are also responsible for any additional fees charged by their PMS/POS system provider in connection with the Gift Card Program.
