According to the 2025 Camp Margaritaville Franchise Disclosure Document, the intellectual property rights for all services are exclusively owned by the Services Provider or its licensors. This means that Camp Margaritaville franchisees are granted a limited license to use the brand's intellectual property, but they do not own it.
This agreement specifies that franchisees cannot apply for or obtain any intellectual property rights that would negatively affect the ownership of Camp Margaritaville's intellectual property by the franchisor, licensor, or their affiliates. Franchisees are also prohibited from challenging the validity of Camp Margaritaville's intellectual property or registering any trademarks or service marks that are confusingly similar to those owned by the franchisor.
Furthermore, any innovations created by the franchisee related to the Camp Margaritaville system are deemed the sole and exclusive property of the franchisor. The franchisor is not obligated to compensate the franchisee for these innovations, and the franchisee cannot use them without prior approval. Upon termination of the franchise agreement, all rights to use Camp Margaritaville's intellectual property automatically revert to the franchisor.
