Who owns the 'Disaggregated Data' derived from Camp Margaritaville's CRM system?

of Customer or end user access to the CRM Service(s) via the Connection Platform, data acquired for Customer by Margaritaville or CRM Provider and loaded into a CRM Services application, or any other data or information of Customer or end user accessed, obtained or provided to Margaritaville or CRM Provider by Customer or an end user pursuant to these CRM Terms of Use. In no event shall Disaggregated Data be considered as, or comprised of, Customer Data.
- "Customer Documentation" shall mean the technical specifications and functionality that CRM provider shall incorporate into the CRM Services, as may be amended from time to time.
- "Disaggregated Data" shall mean numerical or non-numerical data that has been: (1) aggregated from multiple sources and/or on multiple measures, variables and individuals including the Customer, end user and Customer Data broken down into component parts or smaller units of data that are masked or are otherwise anonymous and no longer identifiable as to its source. All Disaggregated Data shall be the sole property of Margaritaville. In no event shall Disaggregated Data be considered as, or comprised of, Confidential information pursuant to Section 7 of these CRM Terms of Use or Customer Data.
- "Documentation" shall mean collectively all documentation given to Customer hereunder, including any end-user manual(s) and Customer Documentation.

According to Camp Margaritaville's 2025 Franchise Disclosure Document, Camp Margaritaville retains sole ownership of 'Disaggregated Data'. Camp Margaritaville grants a license to the CRM Provider and Connection Platform to use Customer Data to provide CRM services. This license includes the ability to copy, anonymize, aggregate, process, disaggregate, and display Disaggregated Data. This is done to derive or compile such data with similar information from other clients for internal statistical or performance analysis by the CRM Provider and/or Connection Platform.
It is important to note that the license granted to the CRM Provider and Connection Platform by Camp Margaritaville for the use of Disaggregated Data survives even if the CRM Terms of Use expire or terminate. This ensures that Camp Margaritaville maintains control and benefit from the data, while allowing the CRM provider to improve its services through aggregated analysis.
