What This Means (2025 FDD)
According to the 2025 FDD, the Minnesota Rider to the Camp Margaritaville franchise agreement is included to ensure compliance with Minnesota state franchise laws. Specifically, certain provisions are added to protect the rights of franchisees in Minnesota.
The rider addresses legal matters such as litigation, ensuring that Camp Margaritaville cannot require franchisees to conduct litigation outside of Minnesota. It also confirms that no part of the franchise agreement can reduce any rights provided to the franchisee under Minnesota Statutes, Chapter 80C, which pertains to franchise regulations within the state.
Furthermore, the Minnesota Rider clarifies that any statements, questionnaires, or acknowledgements signed by the franchisee at the start of their franchise relationship cannot waive claims under state franchise law, including claims of fraud. It also prevents Camp Margaritaville from disclaiming reliance on statements made by the franchisor or its representatives. This provision is explicitly stated to supersede any other conflicting terms in any document related to the franchise agreement, strengthening the franchisee's protections under Minnesota law.
