What This Means (2025 FDD)

According to the 2025 Camp Margaritaville FDD, the franchisor is responsible for obtaining and maintaining appropriate copyright and trademark protection for the Camp Margaritaville Intellectual Property throughout the United States. This includes covering all associated costs and expenses. The franchisor will seek this protection in its own name, the name of its licensor, or the name of an affiliate.

As a Camp Margaritaville franchisee, you are required to cooperate with the franchisor and its affiliates in protecting the Camp Margaritaville Intellectual Property. This cooperation includes providing samples, containers, labels, and similar materials, as well as information about the goods or services offered under the franchise agreement, as reasonably requested by the franchisor. You must also execute and deliver any documents needed to confirm the franchisor's or its affiliate's copyright or trademark ownership rights, without any additional compensation.

The franchisor will take commercially reasonable steps to maintain any registrations of sub-licensed marks during the term of the agreement, again at its own cost and expense, unless it is not legally feasible to do so. This ensures that the intellectual property rights associated with the Camp Margaritaville brand are protected and maintained, benefiting both the franchisor and the franchisee by preserving brand recognition and value.
