What This Means (2025 FDD)
According to the 2025 Camp Margaritaville Franchise Disclosure Document, a franchisee's rights to use the Camp Margaritaville Intellectual Property are indeed limited to the approved site. The franchise agreement specifies that these rights are restricted to the establishment, operation, and promotion of a Resort at and from the approved location. This includes any Selected Amenities that the franchisee is allowed to establish through an executed Amenities Rider.
This means that franchisees cannot use the Camp Margaritaville Intellectual Property to brand or operate other facilities at their Resort or any other Margaritaville-related intellectual property without express prior approval from Camp Margaritaville. The agreement does not grant any rights to use the Intellectual Property in ways not explicitly outlined in the agreement. Any approved use of branded components outside the initial agreement requires a separate agreement or addendum.
These restrictions are typical in franchising, as franchisors like Camp Margaritaville need to maintain brand consistency and control over their intellectual property. For a prospective franchisee, this means understanding that their use of the Camp Margaritaville brand is confined to the specific location and services approved in their franchise agreement. Any expansion or diversification of services using the brand requires further approval and potentially additional agreements with the franchisor.
