Before signing the Franchise Agreement, and while you apply for franchise rights, you must complete our Franchise Application and pay the Application Fee (defined in Item 5). During your evaluation process, and before receiving any Confidential Information, you must sign the Confidentiality and Non-Disclosure Agreement (Exhibit C-6) ("Confidentiality Agreement"). Because we may engage in negotiations with you and other franchisees, you may sign a Franchise Agreement with us that differs significantly from the agreements that other franchisees sign for Camp Margaritaville Resorts.
Competition and the Market
The RV resort market is well-established and highly competitive. Camp Margaritaville Resorts compete with other national Camp Margaritaville Systems and with regional and local RV resorts that offer comparable lodging products. Camp Margaritaville Resorts will target leisure travelers. Some competitors of Camp Margaritaville Resorts may be larger, may operate more RV resorts and may have greater resources than we do.

What This Means (2025 FDD)
According to Camp Margaritaville's 2025 Franchise Disclosure Document, the Confidentiality and Non-Disclosure Agreement (referred to as the "Confidentiality Agreement") is included as Exhibit C-6. Prospective franchisees are required to sign this agreement during the evaluation process, specifically before receiving any confidential information from Camp Margaritaville. This agreement ensures that sensitive business information remains protected during the period when the potential franchisee is assessing the opportunity.
The Confidentiality Agreement is a standard legal document used in franchising to protect the franchisor's proprietary information. It outlines what constitutes confidential information, how it can be used, and the obligations of the franchisee to keep it secret. This is particularly important during the evaluation phase, as potential franchisees gain access to valuable insights into Camp Margaritaville's operations, financial performance, and business strategies.
Camp Margaritaville also requires that upon their request, each General Manager, any other employee, agent, or representative who has access to Confidential Information must sign the Confidentiality Agreement imposing an obligation of confidence regarding the Manual and other Confidential Information. If the franchisee is a corporation, limited liability company or limited partnership, Camp Margaritaville may require the franchisee's shareholders, members, and limited partners to sign a similar written agreement. This highlights the importance Camp Margaritaville places on protecting its confidential information and trade secrets.
