What This Means (2025 FDD)
According to the 2025 Camp Margaritaville FDD, a customer is explicitly prohibited from altering any marks on the Platform related to copyrights, trademarks, trade names, or any other intellectual property rights associated with the Platform or the Services. Additionally, customers are restricted from modifying any software code or using the Platform to avoid payment. This restriction ensures the protection of Camp Margaritaville's intellectual property and the integrity of its Platform.
This provision is typical in franchise agreements to protect the brand's identity and proprietary assets. By preventing unauthorized alterations, Camp Margaritaville maintains control over its brand representation and ensures consistent quality across all franchise locations. This also prevents franchisees from potentially infringing on the brand's trademarks or creating derivative works that could dilute the brand's value.
For a prospective Camp Margaritaville franchisee, this means adhering strictly to the approved usage of the Platform and its associated intellectual property. Any deviation from the prescribed use could result in a breach of the franchise agreement. Franchisees should seek clarification from Camp Margaritaville regarding any specific usage questions to ensure compliance and avoid potential penalties.
