Does Camp Margaritaville have to authorize the goods and services that a franchisee sells?

Camp_Margaritaville Franchise · 2025 FDD

Answer from 2025 FDD Document

You may only sell the goods and services that we authorize. You must sell all goods and services that we specify. We may change these goods and services at any time, and you must comply with the change.

Your rights to use the Camp Margaritaville Intellectual Property are limited to the establishment, operation, and promotion of a Resort (including any Selected Amenities you are allowed to establish through an executed Amenities Rider) at and from the approved site as specifically provided for in the Franchise Agreement. The rights granted to you do not include any rights to brand and operate other facilities at your Resort utilizing the Camp Margaritaville Intellectual Property or any other Margaritaville-related intellectual property, except as expressly approved in advance by us, in our sole discretion. You may not otherwise commercialize or utilize, whether or not for profit, any of the Camp Margaritaville Intellectual Property.

What This Means (2025 FDD)

According to the 2025 Camp Margaritaville FDD, franchisees are only allowed to sell goods and services that Camp Margaritaville authorizes. Moreover, franchisees are required to sell all goods and services that Camp Margaritaville specifies. These goods and services are subject to change at any time, and franchisees must comply with these changes.

This means a prospective Camp Margaritaville franchisee has limited autonomy over their offerings. They cannot introduce new products or services without prior approval from the franchisor. This ensures brand consistency across all Camp Margaritaville locations, but it may also limit a franchisee's ability to cater to local market demands or trends.

Furthermore, the franchisee's rights to use Camp Margaritaville's intellectual property are restricted to the operation and promotion of a resort at the approved site. Any additional use of the intellectual property, such as branding other facilities within the resort, requires express advance approval from Camp Margaritaville. This restriction extends to online activities, as franchisees must obtain approval before developing any website or electronic medium that uses Camp Margaritaville's intellectual property or accepts reservations for the resort.
