What This Means (2025 FDD)
According to Byrider's 2025 Franchise Disclosure Document, the franchise agreement includes standards for the protection of Byrider's proprietary marks. Specifically, the manual outlines a standard for the protection of Byrider's proprietary marks, as indicated in the table of contents.
Upon termination or expiration of the franchise agreement, Byrider franchisees must immediately cease using any of the marks, except as otherwise provided in the agreement. Franchisees are also required to take actions necessary to assign any internet domain names, assumed names, rights, or equivalent registrations containing Byrider's marks to Byrider or Byrider's designee within 30 days of termination or expiration.
Furthermore, Byrider retains the right to establish, operate, and franchise businesses offering similar products or services under trade names, trademarks, service marks, or logos other than the Byrider marks. This highlights that while franchisees are granted a license to use the Byrider marks, Byrider maintains control over its brand and can operate or franchise other businesses under different marks, even within a franchisee's exclusive development area. Licensees are also prohibited from removing, hiding, or disabling any of Byrider's copyright notices on the licensed system.
