wns the approved Business Location, Franchisee agrees that upon termination of this Agreement by Company due to Franchisee's breach or termination by Franchisee without cause prior to the scheduled expiration according to 5.1 herein, Franchisee or its affiliate will, at Company's election, lease the Business Location to Company or its affiliate at market rent for a term of two (2) years.
- 7.4 Opening for Franchisee's Business. The Franchisee shall give the Company at least sixty (60) days prior written notice of the opening of the Franchisee's Business ("Notice of Opening"). If such notice is not given, the Company shall be relieved of its obligation
to provide the assistance in connection with the opening of the Franchisee's Business (provided in Section 6.6 hereof). What This Means (2025 FDD)
According to Byrider's 2025 Franchise Disclosure Document, a franchisee must provide the company with written notice at least sixty (60) days before opening their business. This notification is referred to as the "Notice of Opening."
If the franchisee fails to provide this 60-day notice, Byrider is relieved of its obligation to provide assistance in connection with the opening of the franchisee's business, as detailed in Section 6.6 of the agreement. However, the franchisee cannot open for business until Byrider determines that the construction and preparation of the business location are completed according to the franchise agreement and that the Designated Manager has finished the initial training program.
Within three months after opening, the franchisee must also prepare and submit a Grand Opening advertising and promotion program for Byrider's approval and implement it at the franchisee's expense. This ensures that the opening is properly advertised and promoted to attract customers and establish the business in the local market.
