wns the approved Business Location, Franchisee agrees that upon termination of this Agreement by Company due to Franchisee's breach or termination by Franchisee without cause prior to the scheduled expiration according to 5.1 herein, Franchisee or its affiliate will, at Company's election, lease the Business Location to Company or its affiliate at market rent for a term of two (2) years.
- 7.4 Opening for Franchisee's Business. The Franchisee shall give the Company at least sixty (60) days prior written notice of the opening of the Franchisee's Business ("Notice of Opening"). If such notice is not given, the Company shall be relieved of its obligation
to provide the assistance in connection with the opening of the Franchisee's Business (provided in Section 6.6 hereof). The Franchisee shall not open the Franchisee's Business until the Company reasonably determines that the construction of and other preparation of the Business Location have been completed in accordance with this Agreement and that the Franchisee's Designated Manager has completed the Company'

What This Means (2025 FDD)
According to Byrider's 2025 Franchise Disclosure Document, a franchisee must provide Byrider with written notice at least sixty (60) days before opening their franchise location. This 'Notice of Opening' is a critical requirement. If the franchisee fails to provide this notice, Byrider is relieved of its obligation to provide assistance in connection with the opening of the franchisee's business, as outlined in Section 6.6 of the agreement.
Furthermore, the franchisee cannot open their Byrider business until Byrider determines that the construction and preparation of the business location are completed according to the franchise agreement. Additionally, the Designated Manager must complete Byrider's Initial Training Program before opening.
Within three months after opening, the franchisee is required to develop and submit a Grand Opening advertising and promotion program to Byrider for approval. The franchisee is responsible for implementing this program at their own expense during the Grand Opening. This ensures that the new location is properly introduced to the market and aligns with Byrider's brand standards.
