Under what conditions can a Bw Premier Collection franchisee use the copyrighted items?

According to the 2025 Bw Premier Collection FDD, a franchisee receives a non-exclusive, limited, and non-transferable license to use the copyrighted materials during the term of their agreement. These materials include the words and marks associated with Best Western, BWR (Best Western Rewards), and the specific brand, either BW Premier Collection or BW Signature Collection. This license is granted as part of the services Bw Premier Collection provides to the hotel.

This license is valid only for the duration of the agreement term. The agreement typically ends on December 31st of the tenth year following the hotel's activation on BWI Reservation Channels. The agreement automatically renews for successive ten-year terms unless either party provides notice of non-renewal at least six months before the current term expires.

To maintain the right to use these copyrighted materials, the franchisee must adhere to several obligations. These include maintaining the hotel and providing amenities consistent with its competitive set, completing renovations as outlined in the Property Improvement Plan (PIP), performing a deep-clean program, maintaining a preventative maintenance program, and complying with all quality assurance (QA) processes and procedures. A franchisee must also achieve and maintain a passing BWI QA assessment rating. Failure to meet these obligations could lead to a loss of the license to use the copyrighted materials.
