What This Means (2025 FDD)
According to the 2025 FDD, the Bw Premier Collection franchise agreement has an initial term that ends on December 31st of the tenth year after the hotel's activation on BWI Reservation Channels. This term will automatically renew for successive ten-year periods unless either party provides notice of non-renewal.
To prevent automatic renewal, either Bw Premier Collection or the franchisee must notify the other party of their intent not to renew the agreement at least six months before the end of the current term. For example, if the initial term ends on December 31, 2035, notice must be given by June 30, 2035, to avoid an additional ten-year renewal.
However, for franchises governed by Minnesota law, Bw Premier Collection must provide the Hotel Owner with 180 days' notice for non-renewal of the Distribution Agreement, except in certain specified cases. This means that in Minnesota, the notification deadline is extended to approximately six months prior to the end of the term.
