What This Means (2024 FDD)
According to the 2024 Burros Fries Franchise Disclosure Document, a former franchisee is prohibited from using Burros Fries's trademarks or identifying themselves as a former franchisee after transferring their franchise. This restriction is in place to protect the brand's image and prevent confusion among customers.
Specifically, the franchisee and their owners/principals cannot, directly or indirectly, identify themselves or any business as a current or former Burros Fries business owner. They are also barred from using any Burros Fries mark or anything that imitates it. This includes using any trade name, service mark, or commercial symbol that suggests a connection with Burros Fries.
These restrictions are designed to ensure a clear separation between the former franchisee and the Burros Fries brand. This prevents the former franchisee from leveraging the brand's reputation for their own purposes after they are no longer part of the franchise system. Such measures are standard practice in franchising to maintain brand consistency and protect the franchisor's intellectual property.
This provision is important for prospective franchisees to understand, as it clarifies the limitations they will face if they decide to transfer their franchise in the future. It reinforces the importance of building an independent business identity separate from the Burros Fries brand if they plan to remain in the same industry after the transfer.
