Who is responsible for purchasing or leasing the approved items for a Burros Fries franchise?

for the operation of your Business. We will provide you with such updated lists, but not the actual items as you are responsible for purchasing and/or leasing such items. We will continue to approve products, menu items, retail items, supplies, kitchen equipment, vendors and suppliers you are allowed to use, offer and sell in your Business. You may be responsible for paying any costs related to testing any samples as described in Item 8 (Franchise Agreement, Sections 12.H, 12.I, 12.J, 20.H and 20.I).

  • (3) Suggested pricing for all menu items, retail items. We may establish minimum and maximum prices you can charge to the extent allowed by law.
  • (4) Provide you with updated and approved recipes, food preparation and presentation standards. We will provide you with such updated recipes, standards and specifications and you are responsible for purchasing all ingredients and products that may be necessary for implementation.   • (5) Provide a telephone hotline, free of charge, to answer questions from you or your staff (during regular business hours Pacific Time Zone). You will be able to contact us for questions, suggestions and guidance (Franchise Agreement, Section 20.A).
  • (6) Review and approve advertising and promotional materials in addition to any promotions, edits, changes or updates to your web page that you submit to us (Franchise Agreement, Sections 12.L, 12.H and 20.J).
  • (7) Provide training to any new manager of your Business as noted in paragraph 14 (iv) below. We may require that you (or if you are an Entity or an Owner) and any manager(s) to complete Additional Training programs during the term of the Franchise Agreement (Franchise Agreement, Section 20.A).
  • (8) Offer you guidance in establishing and using administrative, record keeping, and accounting procedures in accordance with our Operations Manual, and various policies communicated by us to you in writing from time to time (Franchise Agreement, Section 20.A).

According to Burros Fries's 2024 Franchise Disclosure Document, the franchisee is responsible for purchasing or leasing approved items. Burros Fries will provide franchisees with updated lists of approved products, menu items, retail items, supplies, kitchen equipment, and services that they are authorized to use, offer, and sell in their business. Burros Fries will also provide updated lists of approved vendors and suppliers for all products, supplies, kitchen equipment, and services that franchisees are allowed to purchase for the operation of their Burros Fries business. However, the franchisee is responsible for the actual purchase or lease of these items.

Burros Fries also provides updated and approved recipes, food preparation, and presentation standards. However, the franchisee is responsible for purchasing all ingredients and products necessary for implementation. The franchisee is obligated to repair and maintain all kitchen equipment, technology items, and related software necessary for the operations of their Burros Fries business and is responsible for these expenses.

Furthermore, the franchisee is required to lease and/or purchase approved items from Burros Fries, their affiliates, and/or their approved vendors. Burros Fries will train franchisees on strategies when leasing and/or purchasing such items for the operation of their business. The franchisee is responsible for the cost, delivery, and installation of these items as they are necessary for the operation of their Burros Fries business.
