We do not own any registered patents or copyrights which are material to the Franchise; however, we claim common law copyright and trade secret protection for several aspects of our System that include: our methods, techniques and operational procedures; all our products, menu and retail items; product specifications, recipes, photographs of food, design, décor, graphics, menus, signage, manuals and all related materials including advertisement and promotional materials although such materials may not have been registered with the United States Copyright Office. These materials are considered proprietary and confidential and are considered our property and may be used by you only as provided in your Franchise Agreement. We reserve the right to register any of our copyrighted materials at any time we deem appropriate. We also reserve the right to renew any and all such copyright registrations at our discretion.

According to the 2024 Burros Fries Franchise Disclosure Document, while Burros Fries does not currently own any registered patents or copyrights material to the franchise, it does claim common law copyright and trade secret protection for various aspects of its system. These aspects include methods, techniques, operational procedures, products, menu and retail items, product specifications, recipes, photographs of food, design, décor, graphics, menus, signage, manuals, and all related advertising and promotional materials. These materials are considered proprietary and confidential and are the property of Burros Fries.
Importantly, Burros Fries explicitly reserves the right to register any of its copyrighted materials at any time it deems appropriate, and it also reserves the right to renew any and all such copyright registrations at its discretion. This means that even though certain materials are not currently registered, Burros Fries retains the option to pursue formal copyright registration in the future.
As a franchisee, you are permitted to use these materials only as provided in the Franchise Agreement. You must also notify Burros Fries immediately in writing of any apparent infringement or challenge to your use of their copyrighted materials or trade secrets. Burros Fries has sole discretion to take action and control any litigation or proceedings related to copyright or trade secret matters. Furthermore, Burros Fries may require you to discontinue or modify any materials that, in their opinion, infringe on the copyright, trade secret, or patent rights of any other person or business. If Burros Fries decides to modify or discontinue the use of any copyrighted materials or trade secrets, you must comply with their directions within a reasonable time after notice, and Burros Fries has no liability to you concerning such substitutions or modifications.
